Resolving tech disputes just got easier!

In most cases, Tech disputes are much like any other commercial dispute.  Often it boils down to whether one party has failed to do what they said they would do under their contract, whether that is in writing or not. 

What distinguishes Tech disputes from other types of commercial dispute is that often complicated evidence is needed to show whether contractual terms have been breached.    Sometimes you will need a Tech Forensic expert to advise on whether a specific piece of software complies with the terms of the contract.  The result is that Tech disputes can be very time-consuming and expensive to resolve. 

We regularly look at alternative methods of dispute resolution, such as mediation, to cut through the expense and time of formal court proceedings.  And, shortly we are likely to have another option to help us resolve Tech Disputes quickly and cheaply for our clients.  The Society of Computers and Law has announced that it is launching a new adjudication procedure for the resolution of technology disputes on 15 October 2019.   Broadly, this will enable parties to agree to submit Tech disputes to a pre-selected panel of adjudicators who shall reach their decision no later than 3 months after their appointment.  This type of procedure is already common in the construction industry and was created to ensure that constructions projects are not held up whilst disputes are resolved.  The aim with the new Tech procedure is for Tech disputes to be fast-tracked to minimise disruption to ongoing projects.
